The service

Kappa is a software tool that performs residential HVAC load calculations using the ACCA Manual J 8 method. It is provided for estimating and design support, based entirely on the inputs you enter.

No professional relationship; not engineering advice

Using Kappa does not create an engineer–client, contractor–client, or other professional relationship, and we are not acting as your engineer, contractor, or design professional. Output is not professional engineering advice and is not a sealed or stamped engineering document. You are responsible for all inputs, for exercising independent professional judgment, and for compliance with all applicable codes and the requirements of the authority having jurisdiction.

Disclaimer of warranties

THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that output will be accurate, complete, code-compliant, or accepted by any permitting authority. Kappa is not ACCA-approved software.

Assumption of risk

Load calculations depend on user-supplied inputs and on a simplified model. You assume all risk of relying on output for any permit application, equipment selection, or installation, and you agree to independently verify results — and have them reviewed by a licensed professional where required — before any such reliance.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [Entity] WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS OR THE COST OF REWORK, EQUIPMENT, OR REMEDIATION, ARISING FROM OR RELATED TO THE SERVICE OR ITS OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50.

Indemnification

You agree to defend, indemnify, and hold harmless [Entity], Microforge, and its officers and agents from any third-party claims, damages, and costs (including reasonable attorneys’ fees) arising from your use of the service or its output, including any permit submission, equipment selection, or installation based on a calculation.

Plans & billing

Paid plans, when available, are billed through Paddle.com (Merchant of Record). Pro plans include a 14-day trial with no card required; a 14-day refund window applies. You can cancel anytime.

Acceptable use

Don’t abuse, reverse-engineer, or resell the service. We may suspend accounts that violate these terms.

Governing law & changes

These terms are governed by the laws of [state/country], without regard to conflict-of-laws rules. We may update these terms; continued use after a change means you accept the updated terms.
